Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Botso Desk websites, shop, dashboard, mobile applications, APIs, and related services (the “Services”). By creating an account, browsing the shop, or completing a purchase, you agree to these Terms and our Risk Disclosure and Privacy Policy.

If you do not agree, do not use the Services.

1. Who we are

Botso Desk (“Botso Desk”, “we”, “us”) provides software and operational infrastructure for autonomous trading strategies, client dashboards, and limited product seats that unlock access to our trading desk environment. Contact: hello@botso.ai.

2. Eligibility

  • You must be at least 18 years old and legally able to enter a binding contract.
  • You must not use the Services if you are prohibited from doing so under applicable law (including sanctions or trading restrictions in your jurisdiction).
  • You are responsible for determining whether use of the Services is lawful where you live.

3. What Botso Desk is (and is not)

  • Botso Desk provides technology and operational access to automated trading strategies run on our infrastructure, together with reporting tools and on-chain visibility where available.
  • Botso Desk is not a bank, broker-dealer, investment adviser, fund manager, or issuer of regulated investment products unless expressly stated in a separate written agreement.
  • Nothing on the Services constitutes investment, financial, legal, or tax advice. Product names, multiples (for example 2×, 3×, 4×), timeframes, and historical or simulated results are illustrative targets or past observations — not promises of profit.
  • You should read the Risk Disclosure before purchasing or funding any seat.

4. Accounts

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for safeguarding login credentials and for activity under your account.
  • Notify us promptly at hello@botso.ai if you suspect unauthorised access.
  • We may suspend or terminate accounts that breach these Terms, present fraud or compliance risk, or threaten platform integrity.

5. Product seats and the shop

  • Products such as The Dub, May 99, and Q4 are limited access seats (digital products/services) that entitle you to participate in the corresponding Botso Desk desk offering under the rules we publish for that product.
  • Inventory is limited. A reservation in cart does not guarantee purchase until payment is successfully completed and confirmed by us.
  • Prices are shown in euro and, unless stated otherwise, include VAT at the applicable rate.
  • Seat features, capacity, and operational parameters may evolve; material changes will be communicated where reasonably practicable.

6. Payments (Revolut)

  • Online card and supported wallet payments are processed by Revolut (or its Merchant affiliates) via secure checkout.
  • By paying, you also accept Revolut’s applicable payer terms for the payment method you use.
  • We receive payment confirmation and order references from Revolut; we do not store full card PAN data on Botso Desk servers.
  • You authorise us to charge the amount displayed at checkout, including VAT.
  • Failed, reversed, or charged-back payments may result in suspension of seat access until resolved.

7. Refunds and cancellations

Important: Product seat fees are charges for access to digital services and operational capacity. Except where mandatory consumer law requires otherwise, purchases are non-refundable once payment is confirmed and access has been (or can be) provisioned.

  • EU/EEA consumer withdrawal: If you are a consumer, you may have a statutory right to withdraw from a distance contract within 14 days. Where you ask us to begin supplying digital services immediately, and you acknowledge that you lose the right to withdraw once performance begins, that right may not apply. Completing checkout for immediate seat access constitutes that request and acknowledgement.
  • If a payment is taken in error, duplicated, or a seat cannot be provisioned for reasons solely within our control, contact hello@botso.ai and we will work to correct or refund the affected charge.
  • Chargebacks filed without contacting us first may delay resolution; we will provide evidence of delivery of digital access to the payment provider where appropriate.

8. Capital, trading activity, and outcomes

  • Any capital you allocate in connection with a seat is subject to market risk. You may lose some or all of amounts exposed to trading.
  • Automated strategies can and do lose money. Latency, outages, venue rules, liquidity, and model behaviour can affect results.
  • SIM or historical views are for illustration and education; they are not live guarantees.
  • We do not guarantee any multiple, timeframe, daily return, or recovery of losses.
  • No liability for trading or system losses. You acknowledge that bots, algorithms, desks, syndicates, and related software or infrastructure may fail, underperform, mis-execute, halt, or experience bugs, outages, data errors, or venue issues. To the fullest extent permitted by law, we and our officers, employees, and affiliates have no liability for any loss of capital, trading losses, missed profits, or consequential losses arising from such events or from market movements. Completing a purchase (or ticking agreement at checkout) constitutes your acceptance of this allocation of risk.

9. Acceptable use

You agree not to:

  • Attempt unauthorised access, disrupt, scrape abusively, or reverse engineer the Services except as permitted by law
  • Misrepresent identity, commit fraud, or use stolen payment instruments
  • Use the Services for unlawful activity or to evade applicable regulations
  • Resell seats or share accounts without our prior written consent

10. Intellectual property

Botso Desk branding, software, documentation, and content are owned by us or our licensors. You receive a limited, revocable, non-exclusive licence to use the Services for your personal or internal business purposes in line with these Terms. You may not copy or exploit our materials for competing services.

11. Third-party services

The Services may link to Discord, app stores, blockchains, exchanges, or other third parties. Those services are governed by their own terms. We are not responsible for third-party content or outages outside our reasonable control.

12. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of uninterrupted availability, error-free operation, or fitness for a particular trading outcome. We do not warrant that automated strategies will be profitable.

13. Limitation of liability

  • Nothing in these Terms excludes liability that cannot be excluded under applicable law (including for death or personal injury caused by negligence, or fraud).
  • Subject to the above, we are not liable for indirect, incidental, special, consequential, or punitive losses, or for lost profits, lost data, or trading losses, whether arising in contract, tort, or otherwise.
  • Our aggregate liability arising out of or relating to a purchase is limited to the fees you paid to Botso Desk for the specific product seat giving rise to the claim in the three months preceding the event.
  • Without limiting the above, we have no liability for loss of funds caused by automated bots, trading systems, software defects, operational failures, or market conditions.

14. Indemnity

You will indemnify Botso Desk against claims, losses, and costs arising from your misuse of the Services, breach of these Terms, or violation of law, except to the extent caused by our wilful misconduct.

15. Suspension and termination

You may stop using the Services at any time. We may suspend or end access where reasonably necessary for security, legal compliance, non-payment, or material breach. Provisions that by nature should survive (including risk disclosures, IP, liability limits, and governing law) will survive termination.

16. Changes

We may update these Terms periodically. The “Last updated” date will change when we do. Continued use after changes take effect constitutes acceptance, except where mandatory law requires express consent.

17. Governing law and disputes

These Terms are governed by the laws of Ireland, without regard to conflict-of-law rules. Courts of Ireland have exclusive jurisdiction, except that consumers may bring proceedings in their country of residence where mandatory consumer law so provides. EU consumers may also use the European Online Dispute Resolution platform where applicable.
